原則15：適当な住居に関する権利
PRINCIPLE 15. The Right to Adequate Housing

すべての人間は、性的指向または性自認を理由とする差別を受けることなく、強制立ち退きから庇護されることも含め、適切な住居を持つ権利を持つ。
Everyone has the right to adequate housing, including protection from eviction, without discrimination on the basis of sexual orientation or gender identity.

国家がなすべきことは：
States shall:

a)避難所その他の緊急の設備を含む、購入可能で、居住に適し、入手可能な、文化水準にふさわしい安全な住居を、性的指向、性自認、婚姻または家族関係による差別を受けることなく保有しまた手に入れる安全を保障するために、必要なあらゆる司法上、行政上その他の対策を取る。
a) Take all necessary legislative, administrative and other measures to ensure security of tenure and access to affordable, habitable, accessible, culturally appropriate and safe housing, including shelters and other emergency accommodation, without discrimination on the basis of sexual orientation, gender identity or marital or family status;

b)国際人権法に基づく義務に適合しない強制立ち退きの執行を禁ずるために、必要なあらゆる司法上、行政上その他の対策を取る。そして、十分かつ効果的な法的またはその他の適切な救済が、強制的な立ち退きからの保護の権利が侵害されているか、侵害される恐れがあるいかなる人にも、性的指向、性自認、婚姻または家族関係による差別を受けることなく、与えられることを保証する。それには、より良い、または同等の土地と適切な住宅を求める権利を含む、住み替えの権利も含まれる。
b) Take all necessary legislative, administrative and other measures to prohibit the execution of evictions that are not in conformity with their international human rights obligations; and ensure that adequate and effective legal or other appropriate remedies areavailable to any person claiming that a right to protection against forced evictions has beenviolated or is under threat of violation, including the right to resettlement, which includes theright to alternative land of better or equal quality and to adequate housing, without discrimination on the basis of sexual orientation, gender identity or marital or family status;

c)性的指向または性自認を理由とする差別なく、地所と家屋の所有権および相続に関する平等の権利を保障する。
c) Ensure equal rights to land and home ownership and inheritance without discrimination on the basis of sexual orientation or gender identity;

d)特に子ども、若者にとって、社会的な排除、家庭内およびその他の形態の暴力、差別、経済的自立の欠如、家族や文化的コミュニティからの拒絶を含む、性的指向と性自認に関してホームレス状態に対するヴァルネラビリティを増大させる諸要因に取り組むための、支援プログラムを含む社会的プログラムを確立する。隣人による支援と安全確保に関する計画の促進も同様である。
d) Establish social programmes, including support programmes, to address factors relating to sexual orientation and gender identity that increase vulnerability to homelessness, especially for children and young people, including social exclusion, domestic and other forms of violence, discrimination, lack of financial independence, and rejection by families or cultural communities, as well as to promote schemes of neighbourhood support and security;

e) すべての関連代理店が、性的指向または性的理由のためにホームレス状態や社会的に不利な立場に直面している人びとの存在に気づき、よく気遣うことを保証するための、教育・啓発プログラムを提供する。
e) Provide training and awareness-raising programmes to ensure that all relevant agencies are aware of and sensitive to the needs of those facing homelessness or social disadvantage as a result of sexual orientation or gender identity.
